(1) Except as provided in subsections (2) and (3), a person violating this act or falsely stating or representing that he or she is or has been an examiner or intern is guilty of a misdemeanor.
(2) A member of the board who intentionally violates section 6(1) shall be subject to the penalties prescribed in Act No. 267 of the Public Acts of 1976.
Terms Used In Michigan Laws 338.1729
- Board: means the state board of forensic polygraph examiners. See Michigan Laws 338.1703
- Examiner: means any person, other than an intern, who does any of the following:
(i) Purports to detect deception, verify truthfulness, or provide a diagnostic opinion of these matters through instrumentation or the use of a mechanical device. See Michigan Laws 338.1703Intern: means a person who is actively engaged in an approved training program pursuant to becoming an examiner. (3) If the board arbitrarily and capriciously violates section 6(3), the board shall be subject to the penalties prescribed in Act No. 442 of the Public Acts of 1976.
