To qualify for state payments under this act, an independent nonprofit institution of higher education shall:
(a) Be incorporated under Act No. 327 of the Public Acts of 1931, as amended, being section 450.98 to 450.192 of the Michigan Compiled Laws, or subject to that act without formal organization thereunder.

- Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
- state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. (b) Submit annually to the state board of education reports which are required and necessary to administer this act.
(c) Maintain for 3 years and make available for inspection records necessary for conducting an audit and for administration of this act.
(d) File with the state board of education a certificate of assurance of compliance with title 6 of the civil rights act of 1964, Public Law 88-352, 78 Stat. 241, as in effect on January 1, 1966.
