- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Arrest: Taking physical custody of a person by lawful authority.
- Assaultive crime: includes any of the following:
(i) A violation described in section 9a of chapter X of the code of criminal procedure, 1927 PA 175, MCL 770. See Michigan Laws 780.621Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account. Contract: A legal written agreement that becomes binding when signed. Conviction: means a judgment entered by a court upon a plea of guilty, guilty but mentally ill, or nolo contendere, or upon a jury verdict or court finding that a defendant is guilty or guilty but mentally ill. See Michigan Laws 780.621a Conviction: A judgement of guilt against a criminal defendant. Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries. Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime. Dismissal: The dropping of a case by the judge without further consideration or hearing. Source: Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other. Felony: means either of the following, as applicable:
(i) For purposes of the offense to be set aside, felony means a violation of a penal law of this state that is punishable by imprisonment for more than 1 year or that is designated by law to be a felony. See Michigan Laws 780.621First violation operating while intoxicated offense: means a violation of any of the following committed by an individual who at the time of the violation has no prior convictions for violating section 625 of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 780.621 Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006. Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC Human trafficking violation: means a violation of chapter LXVIIA of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 780.621 Indian tribe: means an Indian tribe, Indian band, or Alaskan native village that is recognized by federal law or formally acknowledged by a state. See Michigan Laws 780.621 Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases. Misdemeanor: means a violation of any of the following:
(i) A penal law of this state, another state, an Indian tribe, or the United States that is not a felony. See Michigan Laws 780.621month: means a calendar month; the word "year" a calendar year; and the word "year" alone shall be equivalent to the words "year of our Lord". See Michigan Laws 8.3j Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose. Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period. Operating while intoxicated: means a violation of any of the following that is not a first violation operating while intoxicated offense:
(i) Section 625 or 625m of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 780.621person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court. Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government. Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action. Serious misdemeanor: means that term as defined in section 61 of the William Van Regenmorter crime victim's rights act, 1985 PA 87, MCL 780. See Michigan Laws 780.621 state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. Victim: means that term as defined in sections 2, 31, and 61 of the William Van Regenmorter crime victim's rights act, 1985 PA 87, MCL 780.
