Appeals and judicial review.

(1) Any applicant to the association, any person insured pursuant to this article, or their representatives, or any affected* insurer, agent or agency, may appeal to the director within thirty days after any ruling, action or decision by or on behalf of the association, with respect to those items the plan of operation defines as appealable matters.

Terms Used In Missouri Laws 383.190

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Department: the department of commerce and insurance. See Missouri Laws 383.005
  • Director: the director of the department of commerce and insurance. See Missouri Laws 383.005
  • person: may extend and be applied to bodies politic and corporate, and to partnerships and other unincorporated associations. See Missouri Laws 1.020

(2) Any person aggrieved hereunder by any order or act of the director of the department of commerce and insurance may, within ten days after notice thereof, file a petition in the circuit court of the county of Cole for a review thereof. The court shall summarily hear the petition and may make any appropriate order or decree.
