Terms Used In Missouri Laws 473.487

  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Property: includes real and personal property. See Missouri Laws 1.020
  • State: when applied to any of the United States, includes the District of Columbia and the territories, and the words "United States" includes such district and territories. See Missouri Laws 1.020

An executor or administrator may file a petition to sell, mortgage or lease any personal property belonging to the estate. The petition shall set forth the reasons for the application and describe the property involved. The petition may be heard with or without notice as the court directs. Notice of the hearing, if required, shall state briefly the nature of the application and shall be given as provided in section 472.100. The court may order the sale, mortgage or lease of the property described or any part thereof, on the most advantageous terms obtainable. No report or confirmation of the transaction is necessary unless required by the court; but no privately negotiated sale, mortgage or lease made under this section is valid unless prior authorization or subsequent approval of the court is secured.
