17-7-211. Expansion to be authorized — budget amendment. (1) An existing capital project may not be expanded beyond the scope of the project approved by the legislature unless the expansion of the project is authorized by a long-range building program budget amendment approved by the budget director.

Terms Used In Montana Code 17-7-211

  • Agency: means all offices, departments, boards, commissions, institutions, universities, colleges, and any other person or any other administrative unit of state government that spends or encumbers public money by virtue of an appropriation from the legislature under 17-8-101. See Montana Code 17-7-102
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Budget amendment: means a temporary appropriation as provided in Title 17, chapter 7, part 4. See Montana Code 17-7-102
  • Program: means a principal organizational or budgetary unit within an agency. See Montana Code 17-7-102

(2)A proposed long-range building program budget amendment must be submitted to the budget director through the architecture and engineering division of the department of administration. The budget director, through a long-range building program budget amendment, may authorize:

(a)the transfer of excess funds appropriated to a capital project within an agency to increase the appropriation of another capital project within that agency; or

(b)financing to expand a project with funds that were not available for consideration by the legislature.
