2-9-902. (Temporary) Liability. Except as provided in 2-9-903 through 2-9-906, a government entity is not liable for civil damages for injuries or death from or relating to exposure or potential exposure to covid-19 unless the civil action involves an act or omission that constitutes gross negligence, willful and wanton misconduct, or intentional tort. (Terminates December 31, 2031–sec. 12, Ch. 516, L. 2021.)
Terms Used In Montana Code 2-9-902
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Government entity: means the state and political subdivisions, including but not limited to:
(a)political subdivisions as defined in 2-9-101(5);
(b)the legislature, legislative committees, and legislators acting in their official capacity; and
(c)employees of the state or a political subdivision. See Montana Code 2-9-901
- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
