23-2-110. Definitions. For the purposes of this part, the following definitions apply:
Terms Used In Montana Code 23-2-110
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
(1)”Department” means the department of fish, wildlife, and parks.
(2)”Motorized equipment” means any motorized equipment authorized to be used on public lands by the land management agency with jurisdiction over those lands.
(3)”Summer motorized recreation trail” means a trail designated as open to motorized use and approved for inclusion in the summer motorized recreation trail grant program established in 23-2-113 by the land management agency with jurisdiction over the trail.
