23-2-503. Boat liveries. (1) The owner of a boat livery shall cause to be kept a record of the name and address of the person or persons hiring any vessel that is permitted by the owner to be operated, the identification number of the vessel, the departure date and time, and the expected time of return. The record must be preserved for at least 6 months.

Terms Used In Montana Code 23-2-503

  • Motorboat: means a vessel, including a personal watercraft or pontoon, propelled by any machinery, motor, or engine of any description, whether or not the machinery, motor, or engine is the principal source of propulsion. See Montana Code 23-2-502
  • Owner: means a person, other than a lienholder, having the property in or title to a motorboat or vessel. See Montana Code 23-2-502
  • Person: means an individual, partnership, firm, corporation, association, or other entity. See Montana Code 23-2-502
  • Vessel: means every description of watercraft, unless otherwise defined by the department, other than a seaplane on the water, used or capable of being used as a means of transportation on water. See Montana Code 23-2-502

(2)The owner of a boat livery or the owner’s agent or employee may not permit any motorboat or any vessel permitted by the owner to be operated as a motorboat or vessel to depart from the owner’s premises unless it has been provided, either by owner or renter, with the equipment required pursuant to 23-2-521 and any rules made pursuant to that section.
