30-10-909. Fraudulent and other prohibited practices. It is unlawful for a person, in connection with the offer or sale of any living trust, directly or indirectly, in, into, or from this state, to:
Terms Used In Montana Code 30-10-909
- Fraud: Intentional deception resulting in injury to another.
- Living trust: means either an irrevocable or a revocable inter vivos trust. See Montana Code 30-10-903
- Person: means an individual, corporation, partnership, association, joint-stock company, or unincorporated organization. See Montana Code 30-10-903
- Sale: includes each contract of sale, contract to sell, or disposition of a living trust for value. See Montana Code 30-10-903
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
(1)employ any device, scheme, or artifice to defraud;
(2)make any untrue statement of a material fact;
(3)fail to state a material fact necessary to render any statement made not misleading; or
(4)engage in any other act, practice, or course of business that operates or would operate as a fraud or deceit upon any person.
