30-23-106. Enforcement. (1) The attorney general has the sole authority to enforce this part.
Terms Used In Montana Code 30-23-106
- Consumer: means an individual who is a resident of this state. See Montana Code 30-23-102
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Person: means an individual, partnership, corporation, association, business, business trust, or legal representative of an organization. See Montana Code 30-23-102
(2)The attorney general may initiate a civil enforcement action against a person for violation of this part.
(3)In an action to enforce this part, the attorney general may recover:
(a)actual damages to the consumer;
(b)costs;
(c)reasonable attorney fees; and
(d)$2,500 for each violation of 30-23-104.
