33-17-1601. Special qualifications for surety bail bond insurance license. (1) Before approving an application for a surety bail bond insurance license, the commissioner shall verify that the individual:

- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
- Individual: means a natural person. See Montana Code 33-17-102
- License: means a document issued by the commissioner that authorizes a person to act as an insurance producer for the lines of authority specified in the document. See Montana Code 33-17-102
- Person: means an individual or a business entity. See Montana Code 33-17-102
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
- United States: includes the District of Columbia and the territories. See Montana Code 1-1-201
(a)is a natural person at least 21 years of age;
(b)is a citizen of the United States or is lawfully entitled to remain and work in the United States;
(c)has obtained a high school diploma, a general equivalency diploma or equivalent document, or an equivalent education as determined by the commissioner;
(d)has complied with the requirements of 33-17-211; and
(e)has successfully completed the training required in 33-17-1602.
(2)An individual may not receive, renew, or hold a surety bail bond license if the individual:
(a)has been convicted of a felony in this state or of any offense committed in another state that would be a felony if committed in this state; or
(b)has been convicted of an offense involving dishonesty, a breach of trust, violence, threatened violence, or the unlawful use, sale, or possession of a controlled substance.
