37-15-402. Criminal background check. (1) As provided in 37-1-307, the board shall require each applicant for licensure as a speech-language pathologist or audiologist to submit a full set of the applicant’s fingerprints to the board to facilitate a fingerprint-based criminal background check by the Montana department of justice and the federal bureau of investigation. The board may not disseminate criminal history record information resulting from the background check across state lines.

- Audiologist: means a person who practices audiology and who meets the qualifications set forth in this chapter. See Montana Code 37-15-102
- Board: means the board of speech-language pathologists and audiologists provided for in 2-15-1739. See Montana Code 37-15-102
- Department: means the department of labor and industry provided for in Title 2, chapter 15, part 17. See Montana Code 37-15-102
- Speech-language pathologist: means a person who practices speech-language pathology and who meets the qualifications set forth in this chapter. See Montana Code 37-15-102
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
(2)The board may require licensees renewing their licenses to submit a full set of their fingerprints to the board for the purpose of obtaining a criminal record background check by the Montana department of justice and the federal bureau of investigation.
