39-51-2307. School attendance. (1) An individual who is a student attending an established educational institution may qualify for benefits provided that the individual can demonstrate to the department‘s satisfaction that the individual meets the requirements of 39-51-2104.
Terms Used In Montana Code 39-51-2307
- Benefits: means the money payments payable to an individual, as provided in this chapter, with respect to the individual's unemployment. See Montana Code 39-51-201
- Department: means the department of labor and industry provided for in Title 2, chapter 15, part 17. See Montana Code 39-51-201
- Week: means a period of 7 consecutive calendar days ending at midnight on Saturday. See Montana Code 39-51-201
(2)An individual attending an adult basic education class 20 hours a week or less while laid off from a job is not disqualified from receiving benefits if the individual is willing to return to work when notified.
(3)An otherwise eligible individual may not be denied benefits for any week because the individual is in training approved by the department, nor may the individual be denied benefits with respect to any week in which the individual is in training approved by the department by reason of the application of provisions in 39-51-2304 or the application of provisions in 39-51-2104(1)(b).
