40-16-103. Scope. (1) This part governs arbitration of a family law dispute.
Terms Used In Montana Code 40-16-103
- Arbitrator: means an individual selected, alone or with others, to make an award in a family law dispute that is subject to an arbitration agreement. See Montana Code 40-16-102
- Family law dispute: means a contested issue arising under Title 40. See Montana Code 40-16-102
(2)This part does not authorize an arbitrator to make an award that:
(a)grants a legal separation, dissolution of marriage, or invalidity of marriage;
(b)terminates parental rights;
(c)grants an adoption or a guardianship of a child or incapacitated individual; or
(d)issues an order of protection pursuant to Title 40, chapter 15.
