40-5-313. Obligor rights protected — penalties. (1) An employer may not discharge, discipline, or refuse to hire a person because:

Terms Used In Montana Code 40-5-313

  • Employer: includes a payor. See Montana Code 40-5-303
  • Income: means any form of periodic payment to a person, regardless of source, including commissions, bonuses, workers' compensation, disability benefits, payments under a pension or retirement program, interest and earnings, and wages. See Montana Code 40-5-303
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Person: includes a corporation or other entity as well as a natural person. See Montana Code 1-1-201

(a)the person has a child support obligation;

(b)a withholding order has been issued for the person’s income; or

(c)proceedings have been initiated under this part.

(2)An employer who violates the provisions of this section may be fined not more than $100.
