50-30-302. Notice and hearing required prior to prosecution. Before a violation of this chapter is reported to a county attorney for the institution of a criminal proceeding, the person against whom the proceeding is contemplated must be given appropriate notice and an opportunity to present the person’s views before the department, either orally or in writing and either in person or by attorney, with regard to the contemplated proceeding.
