50-48-108. Penalties — misdemeanor. A person who purposefully or knowingly violates any provision of this chapter or rules adopted under 50-48-103 or 50-48-203 is guilty of a misdemeanor. Upon conviction, the person shall be fined:
Terms Used In Montana Code 50-48-108
- Conviction: A judgement of guilt against a criminal defendant.
- Knowingly: means only a knowledge that the facts exist which bring the act or omission within the provisions of this code. See Montana Code 1-1-204
- Person: means an individual, partnership, corporation, association, or other entity engaged in the business of operating, owning, or offering the services of body piercing or tattooing. See Montana Code 50-48-102
(1)an amount of not less than $50 or more than $100 for the first offense;
(2)an amount of not less than $75 or more than $200 for the second offense; and
(3)an amount of not less than $200 and imprisoned in the county jail for not more than 90 days for the third and subsequent offenses.
