50-63-401. Insurer to provide information regarding fire loss to certain agencies upon request. Each insurer engaged in issuing fire insurance policies in the state of Montana shall upon written request of any appropriate law enforcement agency or governmental fire agency organized under Title 7, chapter 33, release to the requesting agency all information in its possession relating to a fire loss of real or personal property. The information may include but is not limited to:

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Person: includes a corporation or other entity as well as a natural person. See Montana Code 1-1-201
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201

(1)any insurance policy relevant to the fire loss under investigation and any application for the policy;

(2)premium payment records;

(3)the history of previous claims made by the insured for fire loss; and

(4)material relating to the investigation of the loss, including statements of any person, proof of loss, and other relevant evidence.
