50-73-401. Coal mine inspector. (1) The department shall employ an adequate number of qualified coal mine inspectors for the enforcement of this chapter and shall prescribe their duties.

Terms Used In Montana Code 50-73-401

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the department of labor and industry and the state coal mine inspectors employed by the department. See Montana Code 50-73-102
  • Person: includes a corporation or other entity as well as a natural person. See Montana Code 1-1-201
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
  • United States: includes the District of Columbia and the territories. See Montana Code 1-1-201

(2)A person is not eligible to be a state coal mine inspector unless the person is a citizen of the United States, is a resident of this state, and has been actually employed in coal mining for 5 years before the appointment.

(3)A state coal mine inspector may not act as the agent for a corporation, superintendent, or manager of a mine and may not be in the employ of mining companies or interested in any way in coal mining operations, either as owner, lessee, or otherwise.
