53-2-105. Misuse of public assistance information unlawful. Except as provided in 53-2-211, it is unlawful for a person, body, association, firm, corporation, or other agency to solicit, disclose, receive, or make use of or to authorize, knowingly permit, participate in, or acquiesce in the use of lists or names for commercial or political purposes of any nature or for any purpose not directly connected with the administration of public assistance. However, the department may, to the extent permitted by federal law, disclose public assistance information to an agency of the state or to any other organization if the information is used solely for purposes directly connected with the administration of a program or purpose of the agency.

Terms Used In Montana Code 53-2-105

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Knowingly: means only a knowledge that the facts exist which bring the act or omission within the provisions of this code. See Montana Code 1-1-204
  • Person: includes a corporation or other entity as well as a natural person. See Montana Code 1-1-201
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
