Terms Used In Montana Code 53-21-406

  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Department: means the department of public health and human services provided for in 2-15-2201. See Montana Code 53-21-102
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
  • State hospital: means the Montana state hospital. See Montana Code 53-21-102

(1)Montana state hospital patients are transferred to a community-based nursing home or other community setting that results in lower expenditures than allowed by legislative appropriation; and

(2)a transfer of appropriations between programs is:

(a)made as provided in 17-7-139; and

(b)approved by the governor.
