7-13-2230. Nonvoting ex officio members — requirements — compensation. (1) A district whose boundaries include a municipality or unincorporated territory may include on its board of directors a nonvoting ex officio member or members as allowed in 7-13-2232.
Terms Used In Montana Code 7-13-2230
- board of directors: means the board of directors of the district elected or appointed as provided in 7-13-2231. See Montana Code 7-13-2201
- County: means one or more counties and includes a city within the county or counties. See Montana Code 7-13-2201
- District: means a district formed under the provisions of this part and part 23. See Montana Code 7-13-2201
- Ex officio: Literally, by virtue of one's office.
- Municipality: means a municipality or a consolidated city and county, city, or town and includes all corporations organized for municipal purposes within a district. See Montana Code 7-13-2201
- Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
- Property: means real and personal property. See Montana Code 1-1-205
(2)A nonvoting ex officio member:
(a)must be appointed by the mayor of the municipality or by the board of county commissioners of the county the member represents;
(b)serves at the pleasure of the appointing authority for the term of office allowed in 7-13-2234;
(c)is not entitled to compensation under 7-13-2273 but may receive compensation from the municipality or county the member represents;
(d)may not hold office as a presiding officer of the district; and
(e)is required to meet the qualifications of a director provided in 7-13-2233 except that the nonvoting ex officio member may reside outside the boundaries of the district and is not required to own property in the district.
