7-32-2248. Inmate endangerment — penalty. (1) A detention center administrator or staff member commits the offense of inmate endangerment if the administrator or staff member knowingly:

- Detention center: means a facility established and maintained by an appropriate entity for the purpose of confining arrested persons or persons sentenced to the detention center. See Montana Code 7-32-2241
- Inmate: means a person who is confined in a detention center. See Montana Code 7-32-2241
- Knowingly: means only a knowledge that the facts exist which bring the act or omission within the provisions of this code. See Montana Code 1-1-204
- Person: includes a corporation or other entity as well as a natural person. See Montana Code 1-1-201
(a)places or keeps a juvenile with adult inmates;
(b)uses corporal punishment against an inmate; or
(c)uses physical force against an inmate, except as necessary for:
(i)self-defense;
(ii)control of inmates;
(iii)protection of another person from imminent physical attack; or
(iv)prevention of riot or escape.
(2)A person who commits the offense of inmate endangerment shall be fined an amount not to exceed $500.
