70-1-313. Interest in common defined. An interest in common is one owned by several persons, not in joint ownership or partnership.

Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
Several: means two or more. See Montana Code 1-1-201
