72-4-305. Right to inspect estate assets for inventory. A person holding property of a nonresident decedent, including any instrument evidencing a debt, obligation, stock, or chose in action, shall permit the domiciliary foreign personal representative of the nonresident decedent to inspect and appraise the property for purposes of completing the inventory called for in 72-4-303(1) upon being presented with proof of the representative’s appointment and an affidavit made by or on behalf of the representative stating:

Terms Used In Montana Code 72-4-305

  • Appraisal: A determination of property value.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Decedent: A deceased person.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Person: includes a corporation or other entity as well as a natural person. See Montana Code 1-1-201
  • Property: means real and personal property. See Montana Code 1-1-205
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201

(1)the date of death of the nonresident decedent;

(2)that no local administration or application or petition for local administration is pending in this state; and

(3)that the domiciliary foreign personal representative is entitled to make the inspection and appraisal.
