76-7-208. Recording and description of easement. (1) An environmental control easement must be recorded in the county where the property is located so as to effect the title in the manner of other conveyances of interest in the property and must describe the property subject to that easement by an adequate legal description or by reference to a recorded plat showing the property’s boundaries.
Terms Used In Montana Code 76-7-208
- Department: means the department of environmental quality provided for in 2-15-3501. See Montana Code 76-7-103
- easement: means an easement created under this chapter that burdens an environmental control site, that runs with the land, and that is binding on the owner and subsequent owners, lessees, and other users of the land. See Montana Code 76-7-103
- Property: means real and personal property. See Montana Code 1-1-205
(2)The county clerk and recorder shall, upon recording, place a copy of the environmental control easement in a separate file within the office of the county clerk and recorder and shall mail a copy of the easement to the department.
