76-8-114. Violations — penalties. (1) If any building is created in violation of this part, the governing body may, in addition to assessing a fine or penalty not to exceed a maximum of $500, initiate an action to:

Terms Used In Montana Code 76-8-114

  • Building: means a structure or a unit of a structure with a roof supported by columns or walls for the permanent or temporary housing or enclosure of persons or property or for the operation of a business. See Montana Code 76-8-101
  • Governing body: means the legislative authority for a city, town, county, or consolidated city-county government. See Montana Code 76-8-101
  • Landowner: means an owner of a legal or equitable interest in real property. See Montana Code 76-8-101

(a)prevent the unlawful creation of the building;

(b)restrain, correct, or abate a violation; or

(c)prevent the occupancy of the building.

(2)For the purposes of enforcing the provisions of this part, the governing body shall attempt to obtain voluntary compliance from the landowner at least 30 days prior to initiating an action for a violation of this part.
