77-1-112. Violations classified. (1) Any officer, employee, or representative of the state who directly or indirectly accepts any money or any other valuable thing, except the officer’s, employee’s, or representative’s regular and lawful compensation, for performing or not performing an official act under the provisions of this title or for modifying the performance of an official act is guilty of a felony and is punishable as provided in 77-1-115.
Terms Used In Montana Code 77-1-112
- Appraisal: A determination of property value.
- Knowingly: means only a knowledge that the facts exist which bring the act or omission within the provisions of this code. See Montana Code 1-1-204
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
- Willfully: when applied to the intent with which an act is done or omitted, means a purpose or willingness to commit the act or make the omission referred to. See Montana Code 1-1-204
(2)Any officer, employee, or representative of the state who knowingly and willfully makes any false classification or appraisal of any state land or of any land offered the state for sale or offered as security for a loan from the state or who falsely classifies or scales any timber on state lands or from state lands or any timber in which the state is interested or who knowingly and willfully makes any false report of any classification or appraisal or scaling is guilty of a felony and is punishable as provided in 77-1-115.
(3)(a) Any officer, employee, or representative of the state who otherwise violates any of the provisions of this title:
(i)is guilty of a felony if the violation results in a loss to the state of $1,000 or more; or
(ii)is guilty of a misdemeanor if the violation results in a loss to the state of less than $1,000 or in no pecuniary loss.
(b)The punishment shall be as provided in 77-1-115.
