82-15-112. Injunction against violations. The department may apply to any court of competent jurisdiction for a temporary or permanent injunction, or both, restraining any person for violating any provision of this part or any rule promulgated by the department pursuant to this part.
Terms Used In Montana Code 82-15-112
- Department: means the department of labor and industry provided for in Title 2, chapter 15, part 17. See Montana Code 82-15-101
- Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Person: means an individual, trust, estate, partnership, corporation, joint-stock company, firm, agency, association, or any receiver appointed by law. See Montana Code 82-15-101
