Terms Used In Montana Code > Title 30 > Chapter 22 - Nonferrous Metal Transactions

  • Nonferrous metal: means metal and metal alloys not containing significant quantities of iron or steel, including but not limited to:

    (a)copper;

    (b)brass;

    (c)aluminum, other than aluminum cans;

    (d)bronze;

    (e)lead;

    (f)zinc;

    (g)nickel;

    (h)stainless steel, including stainless steel beer kegs; and

    (i)precious metals, including catalytic converters and their component parts and materials. See Montana Code 30-22-101

  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Peace officer: has the meaning as defined in 46-1-202. See Montana Code 1-1-207
  • Person: means an individual, partnership, corporation, joint venture, trust, association, or any other legal entity. See Montana Code 30-22-101
  • Salvage metal dealer: means a person who is engaged in the business of paying, trading, recycling, or bartering for or collecting nonferrous metals that have served their original economic purpose, whether or not the person is engaged in the business of performing the manufacturing process by which ferrous metals or nonferrous metals are converted into raw material products consisting of prepared grades and having an existing or potential economic value.   • Seller: means a person who sells or delivers nonferrous metal or otherwise makes nonferrous metal available to a salvage metal dealer. See Montana Code 30-22-101
