A trial is a judicial examination of the issues, whether of law or of fact in an action.

- Action: shall include any proceeding in any court of this state. See Nebraska Statutes 49-801
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
