Terms Used In Nebraska Statutes > Physical Therapy Practice Act
- Action: shall include any proceeding in any court of this state. See Nebraska Statutes 49-801
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Approved educational program: means a program for the education and training of physical therapists and physical therapist assistants approved by the board pursuant to section Nebraska Statutes 38-2904
- Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
- Arrest: Taking physical custody of a person by lawful authority.
- Attorney: shall mean attorney at law. See Nebraska Statutes 49-801
- Board: means the Board of Physical Therapy. See Nebraska Statutes 38-2905
- Chambers: A judge's office.
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Direct supervision means supervision in which the supervising practitioner is physically present and immediately available and does not: include supervision provided by means of telecommunication. See Nebraska Statutes 38-2906
- Evaluation: means the process of making clinical judgments based on data gathered from examination of a patient. See Nebraska Statutes 38-2907
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
- Foreign: when applied to corporations shall include all those created by authority other than that of this state. See Nebraska Statutes 49-801
- General supervision means supervision either onsite or by: means of telecommunication. See Nebraska Statutes 38-2908
- Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Magistrate: shall include judge of the county court and clerk magistrate. See Nebraska Statutes 49-801

- Mobilization or manual therapy: means a group of techniques comprising a continuum of skilled passive movements to the joints or related soft tissues, or both, throughout the normal physiological range of motion that are applied at varying speeds and amplitudes, without limitation. See Nebraska Statutes 38-2910
- Non-treatment-related tasks: means clerical, housekeeping, facility maintenance, or patient transportation services related to the practice of physical therapy. See Nebraska Statutes 38-2911
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person: shall include bodies politic and corporate, societies, communities, the public generally, individuals, partnerships, limited liability companies, joint-stock companies, and associations. See Nebraska Statutes 49-801
- Physical therapist: means a person licensed to practice physical therapy under the Physical Therapy Practice Act. See Nebraska Statutes 38-2912
- Physical therapist assistant: means a person certified as a physical therapist assistant under the Physical Therapy Practice Act. See Nebraska Statutes 38-2913
- Physical therapy aide: means a person who is trained under the direction of a physical therapist and who performs treatment-related and non-treatment-related tasks. See Nebraska Statutes 38-2915
- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Process: shall mean a summons, subpoena, or notice to appear issued out of a court in the course of judicial proceedings. See Nebraska Statutes 49-801
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- State: when applied to different states of the United States shall be construed to extend to and include the District of Columbia and the several territories organized by Congress. See Nebraska Statutes 49-801
- Statute: A law passed by a legislature.
- Student: means a person enrolled in an approved educational program. See Nebraska Statutes 38-2916
- Subpoena: A command to a witness to appear and give testimony.
- Sworn: shall include affirmed in all cases in which an affirmation may be substituted for an oath. See Nebraska Statutes 49-801
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Testing: means standard methods and techniques used to gather data about a patient. See Nebraska Statutes 38-2917
- Treatment-related tasks: means activities related to the practice of physical therapy that do not require the clinical decisionmaking of a physical therapist or the clinical problem solving of a physical therapist assistant. See Nebraska Statutes 38-2918
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- United States: shall include territories, outlying possessions, and the District of Columbia. See Nebraska Statutes 49-801
- Writ: A formal written command, issued from the court, requiring the performance of a specific act.
- Year: shall mean calendar year. See Nebraska Statutes 49-801
