Nevada Revised Statutes 239.0113 – Burden of proof where confidentiality of public book or record is at issue
Except as otherwise provided in NRS 239.0115, if:
Terms Used In Nevada Revised Statutes 239.0113
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Governmental entity: means :
(a) An elected or appointed officer of this State or of a political subdivision of this State;
(b) An institution, board, commission, bureau, council, department, division, authority or other unit of government of this State, including, without limitation, an agency of the Executive Department, or of a political subdivision of this State;
(c) A university foundation, as defined in Nevada Revised Statutes 239.005
1. The confidentiality of a public book or record, or a part thereof, is at issue in a judicial or administrative proceeding; and
2. The governmental entity that has legal custody or control of the public book or record asserts that the public book or record, or a part thereof, is confidential, the governmental entity has the burden of proving by a preponderance of the evidence that the public book or record, or a part thereof, is confidential.
