1. Except as otherwise provided in subsection 2, NRS 439.597, 442.300 to 442.330, inclusive, and 449A.103 and chapter 629 of NRS, the registration and other records of a treatment facility and treatment provider are confidential and must not be disclosed to any person not connected with the treatment facility or treatment provider without the consent of the patient.
Terms Used In Nevada Revised Statutes 458.280
- Facility: means a physical structure used for the education, prevention and treatment, including mental and physical restoration, of persons with alcohol or other substance use disorders. See Nevada Revised Statutes 458.010
- person: means a natural person, any form of business or social organization and any other nongovernmental legal entity including, but not limited to, a corporation, partnership, association, trust or unincorporated organization. See Nevada Revised Statutes 0.039
- Treatment provider: means a public or private agency, residential treatment center, facility for the treatment of alcohol or other substance use disorders, voluntary organization which is certified by the Division or a practitioner licensed or certified pursuant to chapter 641, 641A, 641B or 641C of NRS. See Nevada Revised Statutes 458.010
2. The provisions of subsection 1 do not restrict the use of a patient’s records for the purpose of research into the causes and treatment of alcoholism if such information is:
(a) Not published in a way that discloses the patient’s name or other identifying information; or
(b) Disclosed pursuant to NRS 439.597.
