1.  In addition to any other penalty, the Board may issue a citation to:

Terms Used In Nevada Revised Statutes 644A.955

  • person: means a natural person, any form of business or social organization and any other nongovernmental legal entity including, but not limited to, a corporation, partnership, association, trust or unincorporated organization. See Nevada Revised Statutes 0.039

(a) A person who violates the provisions of NRS 644A.900.

(b) A licensee or registrant who violates the provisions of NRS 644A.850.

2.  A citation issued pursuant to subsection 1 must be in writing and describe with particularity the nature of the violation. The citation also must inform the person of the provisions of NRS 644A.960. A separate citation must be issued for each violation. The citation may include, without limitation:

(a) An order to cease and desist, if appropriate; and

(b) An order to pay an administrative fine for each violation.

3.  If the citation is issued to a licensee or registrant and includes an order to pay an administrative fine for one or more violations of the provisions of NRS 644A.850, the amount of the administrative fine must not exceed the maximum amount authorized by NRS 644A.850.

4.  If the citation is issued to a person and includes an order to pay an administrative fine for one or more violations of the provisions of NRS 644A.900, the amount of the administrative fine must be:

(a) For a first violation, $1,000.

(b) For a second violation, $1,500.

(c) For a third or subsequent violation, $2,000.

5.  The provisions of this section and NRS 644A.960 do not apply to the issuance of a citation by any inspector of the Board pursuant to subsection 3 of NRS 644A.865 and do not limit the authority of an inspector of the Board to issue such a citation.
