Terms Used In Nevada Revised Statutes > Chapter 488 - Watercraft
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Aquatic invasive species: means an aquatic species which is exotic or not native to this State and which the Commission has determined to be detrimental to aquatic life, water resources or infrastructure for providing water in this State. See Nevada Revised Statutes 488.035
- Aquatic plant material: means aquatic plants or parts of plants that are dependent on an aquatic environment to survive. See Nevada Revised Statutes 488.035
- Arrest: Taking physical custody of a person by lawful authority.
- Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
- Charter school: means a public school that is formed pursuant to the provisions of chapter 388A of NRS. See Nevada Revised Statutes 385.007
- Commission: means the Board of Wildlife Commissioners. See Nevada Revised Statutes 488.035
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Contract: A legal written agreement that becomes binding when signed.
- controlled substance: means a drug, immediate precursor or other substance which is listed in schedule I, II, III, IV or V for control by the State Board of Pharmacy pursuant to Nevada Revised Statutes 0.031
- Conveyance: means a motor vehicle, trailer or any other equipment used to transport a vessel or containers or devices used to haul water on a vessel that may contain or carry an aquatic invasive species or aquatic plant material. See Nevada Revised Statutes 488.035
- Conviction: A judgement of guilt against a criminal defendant.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- county: includes Carson City. See Nevada Revised Statutes 0.033
- Credit bureau: An agency that collects individual credit information and sells it for a fee to creditors so they can make a decision on granting loans. Typical clients include banks, mortgage lenders, credit card companies, and other financing companies. (Also commonly referred to as consumer-reporting agency or credit-reporting agency.) Source: OCC
- Custodial parent: means the parent of a child born out of wedlock who has been awarded physical custody of the child or, if no award of physical custody has been made by a court, the parent with whom the child resides. See Nevada Revised Statutes 126.021
- Decedent: A deceased person.
- Decontaminate: means eliminate any aquatic invasive species on a vessel or conveyance in a manner specified by the Commission which may include, without limitation, washing the vessel or conveyance, draining the water in the vessel or conveyance, drying the vessel or conveyance or chemically, thermally or otherwise treating the vessel or conveyance. See Nevada Revised Statutes 488.035
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Department: means the Department of Wildlife. See Nevada Revised Statutes 488.035
- Department: means the Department of Education. See Nevada Revised Statutes 385.007
- Dependent: A person dependent for support upon another.
- Director: means the Director of the Department. See Nevada Revised Statutes 481.015
- Division: means the Division of Child and Family Services of the Department of Health and Human Services. See Nevada Revised Statutes 127.003
- Docket: A log containing brief entries of court proceedings.
- Donor: The person who makes a gift.
- Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
- Escrow: Money given to a third party to be held for payment until certain conditions are met.
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Fiduciary: A trustee, executor, or administrator.
- Flat wake: means the condition of the water close astern a moving vessel that results in a flat wave disturbance. See Nevada Revised Statutes 488.035
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Hull identification number: means the number assigned to a vessel pursuant to Nevada Revised Statutes 488.035
- Human-powered vessel: means a vessel propelled by human power. See Nevada Revised Statutes 488.035
- Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Legal owner: means a secured party under a security agreement relating to a vessel or a renter or lessor of a vessel to the State or any political subdivision of the State under a lease or an agreement to lease and sell or to rent and purchase which grants possession of the vessel to the lessee for a period of 30 consecutive days or more. See Nevada Revised Statutes 488.035
- Mechanically propelled personal hydrofoil: means a power-driven vessel that consists of a board fitted with a mast extending below the board that is attached to a fuselage with a forward wing, rear stabilizer and electric motor or internal combustion engine. See Nevada Revised Statutes 488.035
- Motorized surfboard: means a power-driven vessel that consists of a board using a surfboard-type design fitted with either an electric motor or internal combustion engine. See Nevada Revised Statutes 488.035
- Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Operate: means to navigate or otherwise use a vessel. See Nevada Revised Statutes 488.035
- Owner: means :
(a) A person having all the incidents of ownership, including the legal title of a vessel, whether or not he or she lends, rents or pledges the vessel;
(b) A debtor under a security agreement relating to a vessel; or
(c) A person, other than a secured party, who has a property right with regard to a human-powered vessel, including, without limitation, a person entitled to use or possess a human-powered vessel subject to a security interest of another person. See Nevada Revised Statutes 488.035
- Parent and child relationship: means the legal relationship existing between a child and his or her natural or adoptive parents incident to which the law confers or imposes rights, privileges, duties and obligations. See Nevada Revised Statutes 126.021
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- person: means a natural person, any form of business or social organization and any other nongovernmental legal entity including, but not limited to, a corporation, partnership, association, trust or unincorporated organization. See Nevada Revised Statutes 0.039
- Person: has the meaning ascribed to it in Nevada Revised Statutes 488.035
- Personal property: All property that is not real property.
- physician: means a person who engages in the practice of medicine, including osteopathy and homeopathy. See Nevada Revised Statutes 0.040
- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Power-driven vessel: means any vessel propelled by machinery, whether or not the machinery is the principal source of propulsion. See Nevada Revised Statutes 488.035
- Preliminary hearing: A hearing where the judge decides whether there is enough evidence to make the defendant have a trial.
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
- Prohibited substance: has the meaning ascribed to it in Nevada Revised Statutes 488.035
- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- Public schools: means all kindergartens and elementary schools, junior high schools and middle schools, high schools, charter schools and any other schools, classes and educational programs which receive their support through public taxation and, except for charter schools, whose textbooks and courses of study are under the control of the State Board. See Nevada Revised Statutes 385.007
- Registered owner: means the person registered by the Department as the owner of a vessel. See Nevada Revised Statutes 488.035
- Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
- Sailing vessel: means a vessel that is propelled by wind power and is not equipped with a motor. See Nevada Revised Statutes 488.035
- State Board: means the State Board of Education. See Nevada Revised Statutes 385.007
- State hull number: means a hull number issued for a vessel by the Department that meets the requirements prescribed by the United States Coast Guard, including, without limitation, Nevada Revised Statutes 488.035
- State of principal operation: means the state in whose waters a vessel is or will be operated most during a calendar year. See Nevada Revised Statutes 488.035
- Statute: A law passed by a legislature.
- Subpoena: A command to a witness to appear and give testimony.
- substantial bodily harm: means :
- Testimony: Evidence presented orally by witnesses during trials or before grand juries.
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
- Under the influence: means impaired to a degree that renders a person incapable of safely operating or exercising actual physical control of a vessel. See Nevada Revised Statutes 488.035
- University school for profoundly gifted pupils: has the meaning ascribed to it in Nevada Revised Statutes 385.007
- Vessel: means every description of watercraft, other than a seaplane on the water, used or capable of being used as a means of transportation on water. See Nevada Revised Statutes 488.035
- Waters of this State: means any waters within the territorial limits of this State. See Nevada Revised Statutes 488.035
