- Administrator: means the Administrator of the Purchasing Division. See Nevada Revised Statutes 333.020
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appraisal: A determination of property value.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Authorized representative: means a person designated by the governing body to be responsible for the development, award and proper administration of all purchases and contracts for a local government or a department, division, agency, board or unit of a local government made pursuant to this chapter. See Nevada Revised Statutes 332.025
- Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
- Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
- Bequest: Property gifted by will.
- Best value: means the greatest possible economy consistent with grades or qualities of supplies, materials, equipment and services that are adapted to the purposes to be served. See Nevada Revised Statutes 333.020
- confidential business information: means any information relating to the amount or source of any income, profits, losses or expenditures of a person, including data relating to cost or price submitted in support of a bid or proposal. See Nevada Revised Statutes 333.020
- confidential business information: means any information relating to the amount or source of any income, profits, losses or expenditures of a person, including data relating to cost, price, or the customers of a responding offeror which is submitted in support of a response. See Nevada Revised Statutes 332.025
- Contract: A legal written agreement that becomes binding when signed.
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- county: includes Carson City. See Nevada Revised Statutes 0.033
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Director: means the Director of the Department of Administration. See Nevada Revised Statutes 333.020
- Evaluator: means an authorized representative, officer, employee, representative, agent, consultant or member of a governing body who has participated in:
(a) The evaluation of responses;
(b) Negotiations concerning purchasing by a local government; or
(c) The review or approval of the award, modification or extension of a contract. See Nevada Revised Statutes 332.025
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Governing body: means the board, council, commission or other body in which the general legislative and fiscal powers of the local government are vested. See Nevada Revised Statutes 332.025
- Invitation to bid: means a written statement which sets forth the requirements and specifications of a contract to be awarded by competitive selection. See Nevada Revised Statutes 333.020
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- local government: means :
(a) Every political subdivision or other entity which has the right to levy or receive money from ad valorem taxes or other taxes or from any mandatory assessments, including counties, cities, towns, school districts and other districts organized pursuant to chapters 244, 318, 318A, 379, 450, 474, 539, 541, 543 and 555 of NRS. See Nevada Revised Statutes 332.015
- Local school precinct: has the meaning ascribed to it in Nevada Revised Statutes 332.025
- person: means a natural person, any form of business or social organization and any other nongovernmental legal entity including, but not limited to, a corporation, partnership, association, trust or unincorporated organization. See Nevada Revised Statutes 0.039
- Personal property: All property that is not real property.
- population: means the number of people in a specified area as determined by the last preceding national decennial census conducted by the Bureau of the Census of the United States Department of Commerce pursuant to Section 2 of Nevada Revised Statutes 0.050
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Proprietary information: means :
(a) Any trade secret or confidential business information that is contained in a response submitted to a governing body or its authorized representative on a particular contract; or
(b) Any other trade secret or confidential business information submitted to a governing body or its authorized representative by a responding offeror and designated as proprietary by the governing body or its authorized representative. See Nevada Revised Statutes 332.025
- Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
- Purchasing Division: means the Purchasing Division of the Department of Administration. See Nevada Revised Statutes 333.020
- Quorum: The number of legislators that must be present to do business.
- Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
- Request for proposals: means a written statement which sets forth the requirements and specifications of a contract to be awarded by competitive selection. See Nevada Revised Statutes 333.020
- Responding offeror: means a person who responds to a solicitation made by a governing body or its authorized representative. See Nevada Revised Statutes 332.025
- Solicitation: means a written statement which sets forth the requirements and specifications of a contract to be awarded by:
(a) An invitation to bid;
(b) A request for proposals;
(c) A request for a statement of qualifications;
(d) A request for a quotation; or
(e) Any other accepted method of purchasing that complies with the provisions of this chapter. See Nevada Revised Statutes 332.025
- Statute: A law passed by a legislature.
- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
- Trade secret: has the meaning ascribed to it in Nevada Revised Statutes 332.025
- Trade secret: has the meaning ascribed to it in Nevada Revised Statutes 333.020
- Trustee: A person or institution holding and administering property in trust.
- Using agencies: means all officers, departments, divisions, institutions, boards, commissions and other agencies in the Executive Department of the State Government which derive their support from public money in whole or in part, whether the money is provided by the State of Nevada, received from the Federal Government or any branch, bureau or agency thereof, or derived from private or other sources. See Nevada Revised Statutes 333.020
- Volunteer fire department: means a volunteer fire department which pays premiums for industrial insurance pursuant to the provisions of chapters 616A to 616D, inclusive, or chapter 617 of NRS. See Nevada Revised Statutes 333.020
