Terms Used In New Hampshire Revised Statutes 106-F:13
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
All decisions by the commissioner affecting licensing shall be mailed by certified mail to the applicant’s last known address. Appeals from such decisions to the superior court shall be permitted as a matter of right, if taken within 30 days after the date received. In any such appeal the right to trial by jury shall be obtained, if requested in advance. No appeal taken from a decision of the commissioner shall suspend the operation or effect of such decision unless so ordered by a justice of the superior court.
