Terms Used In New Hampshire Revised Statutes 110-B:45

  • Arrest: Taking physical custody of a person by lawful authority.
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
Any person subject to N.H. Rev. Stat. Chapter 110-B charged with an offense hereunder shall be ordered into arrest or confinement as circumstances may require; but, when charged only with an offense normally tried by summary court-martial, such person shall not ordinarily be placed in confinement. When any person subject to this chapter is placed in arrest or confinement prior to trial, immediate steps shall be taken to inform the person of the specific wrong of which the person is accused and to try the person or dismiss the charges and release the person.
