New Hampshire Revised Statutes 260:14-a – Provision for Federal Identification Database Prohibited

I. Except as provided in this section, the department shall not provide, directly or indirectly, a complete, or substantially complete or mirrored, extract of motor vehicle records, or a significant portion thereof, that contain personally identifiable information from any file or database to the federal or any state government or to any agent or agency of, or contractor engaged by, the federal or any state governments.
II. Notwithstanding any law to the contrary, the department is authorized to participate in the National Driver Register (NDR) and Problem Driver Pointer System (PDPS), to achieve the state’s compliance with the provisions of the National Driver Register Act of 1982, as amended, and its implementing regulations, and to facilitate the state’s compliance with the provisions of the driver license compact authorized by N.H. Rev. Stat. § 263:77.
III. Notwithstanding any law to the contrary, the department is authorized to participate in the Commercial Driver‘s License Information System (CDLIS), to achieve the state’s compliance with the provisions of the Federal Commercial Motor Vehicle Safety Act 1986, as amended, and its implementing regulations.
IV. Notwithstanding any law to the contrary, the department is authorized to participate in the National Law Enforcement Telecommunications System (NLETS).
V. Notwithstanding any law to the contrary, the department is authorized to participate in the National Motor Vehicle Title Information System (NMVTIS), to achieve the state’s compliance with the provisions of the Federal Anti Car Theft Act of 1992, as amended, and its implementing regulations.
VI. Notwithstanding any law to the contrary, the department is authorized to participate in the state to state (S2S) driver information program.
VII. Notwithstanding any law to the contrary, the department is authorized to participate in the driver license data verification (DLDV) program.
VIII. Notwithstanding any law to the contrary, the department may provide driver history records to a federal entity for uses authorized in N.H. Rev. Stat. § 260:14, IV, N.H. Rev. Stat. § 260:14, IV-a, and N.H. Rev. Stat. § 260:14, V.
II. Terms Used In New Hampshire Revised Statutes 260:14-a
- Commercial driver: shall mean a person who drives a commercial motor vehicle as defined in N. See New Hampshire Revised Statutes 259:12
- Commercial motor vehicle: shall mean a motor vehicle or a combination of motor vehicles, used in commerce, to transport passengers or property if:
(a) The vehicle has a gross vehicle weight rating of 26,001 pounds or more;
(b) The vehicle has a gross combination weight rating or actual weight of 26,001 or more pounds, inclusive of any towed unit with gross vehicle weight rating or actual weight of more than 10,000 pounds;
(c) The vehicle is designed or used to transport 16 or more passengers, including the driver; or
(d) The vehicle is of any size and is used in the transportation of hazardous materials required to be placarded under 49 C. See New Hampshire Revised Statutes 259:12-e - Department: shall mean the department of safety of the state of New Hampshire. See New Hampshire Revised Statutes 259:19
- Driver: shall mean a person who drives or is in actual physical control of a motor vehicle as defined in N. See New Hampshire Revised Statutes 259:25
- License: shall mean any driver's license or any other license or permit to drive a vehicle issued under the laws of this state or a reciprocating state including:

III.
