No employer shall require as a condition of employment that any employee or applicant for employment abstain from using tobacco products outside the course of employment, as long as the employee complies with any workplace policy, pursuant to N.H. Rev. Stat. § 155:51-53 and, when applicable, N.H. Rev. Stat. § 155:64-77.
