If in any town having 50 families or more settled therein there is no clerk of the proprietors of the common lands lying in such towns residing therein, the town clerk thereof shall demand and receive the proprietary records of any person having the possession thereof, and shall keep the same with the records of the town; and any person having possession thereof shall deliver the same to such town clerk.
