Terms Used In New Hampshire Revised Statutes 406-A:4
- commissioner: shall mean the insurance commissioner of this state. See New Hampshire Revised Statutes 406-A:2
- following: when used by way of reference to any section of these laws, shall mean the section next preceding or following that in which such reference is made, unless some other is expressly designated. See New Hampshire Revised Statutes 21:13
- Residents: shall mean and include person, partnership or corporation, domestic, alien or foreign. See New Hampshire Revised Statutes 406-A:2
- state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4
- Unfair trade practice act: shall mean Revised Statutes Annotated, chapter 417, entitled Unfair Insurance Trade Practices. See New Hampshire Revised Statutes 406-A:2
If after 30 days following the giving of the notice mentioned in N.H. Rev. Stat. § 406-A:3 such insurer has failed to cease making, issuing, or circulating such false misrepresentations or causing the same to be made, issued or circulated in this state, and if the commissioner has reason to believe that a proceeding by him in respect to such matters would be to the interest of the public, and that such insurer is issuing or delivering contracts of insurance to residents of this state or collecting premiums on such contracts or doing any of the acts enumerated in N.H. Rev. Stat. § 406-A:5, he shall take action against such insurer under the unfair trade practice act.
