- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Probable cause: A reasonable ground for belief that the offender violated a specific law.
Notwithstanding the jurisdictional provisions of N.H. Rev. Stat. § 592-B:1, the circuit court – district division shall have jurisdiction to arraign defendants charged with felony offenses and to hold a preliminary examination to determine whether probable cause exists to believe the offense was committed and the defendant committed the offense, and if so, to be bound over to the superior court for further proceedings. The supreme court shall adopt such rules as may be required to effect the purpose of this section.
