- Continuance: Putting off of a hearing ot trial until a later time.
- Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Plaintiff: The person who files the complaint in a civil lawsuit.
The plaintiff is entitled to one continuance in case of a setoff, unless a particular statement of the debt or demand, with a notice that the defendant will set off the same, has been served on the plaintiff ten days before the sitting of the court.
