Terms Used In New Hampshire Revised Statutes > Chapter 358-I - Health Clubs
- buyer: means a natural person who enters into a health club contract or attains a status entitling him to the services or facilities of a health club. See New Hampshire Revised Statutes 358-I:1
- Contract: A legal written agreement that becomes binding when signed.
- Contract: means a monthly contract or a term contract:
(a) "Monthly contract" means any contract where services are paid on a monthly basis. See New Hampshire Revised Statutes 358-I:1 - Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Escrow: Money given to a third party to be held for payment until certain conditions are met.
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Facilities: means equipment, physical structures, and other tangible property utilized by a health club to conduct its business. See New Hampshire Revised Statutes 358-I:1
- following: when used by way of reference to any section of these laws, shall mean the section next preceding or following that in which such reference is made, unless some other is expressly designated. See New Hampshire Revised Statutes 21:13
- Health club: means an establishment which provides services or facilities which purport to improve or maintain the user's physical condition or appearance through weight control, exercise, dieting, or a combination of these. See New Hampshire Revised Statutes 358-I:1
- Initiation fee: means any sum of money received at the initiation of a membership for the incurred costs including but not limited to advertising, administration, commissions, and orientation. See New Hampshire Revised Statutes 358-I:1
- justice: when applied to a magistrate, shall mean a justice of a municipal court, or a justice of the peace having jurisdiction over the subject-matter. See New Hampshire Revised Statutes 21:12
- Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
- Member: or "buyer" means a natural person who enters into a health club contract or attains a status entitling him to the services or facilities of a health club. See New Hampshire Revised Statutes 358-I:1
- month: shall mean a calendar month, and the word "year" a calendar year, unless otherwise expressed; and the word "year" shall be equivalent to the expression "year of our Lord. See New Hampshire Revised Statutes 21:8
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
- Prepayment: means any payment for services or the use of facilities made before the services or facilities are made available by the health club. See New Hampshire Revised Statutes 358-I:1
- Seller: means the person, corporation, partnership, association, or other entity engaged in the operation of a health club as defined in this section, and who offers for sale the right to use the facilities or the services of the health club. See New Hampshire Revised Statutes 358-I:1
- Services: means programs, plans, guidance, or instruction provided by a health club for health club members. See New Hampshire Revised Statutes 358-I:1
- state: when applied to different parts of the United States, may extend to and include the District of Columbia and the several territories, so called; and the words "United States" shall include said district and territories. See New Hampshire Revised Statutes 21:4
- Term contract: means any contract where services are paid for in advance for a period of time greater than one month. See New Hampshire Revised Statutes 358-I:1
