(a) Upon receipt by the commissioner of a record of conviction of failing to show evidence of financial responsibility pursuant to § 55-12-139, the commissioner shall suspend the driver license of the person convicted of this offense.

Terms Used In Tennessee Code 55-12-115

  • Commissioner: means the commissioner of safety, unless otherwise indicated or unless the context otherwise requires. See Tennessee Code 55-12-102
  • Conviction: A judgement of guilt against a criminal defendant.
  • Driver: means :
    (A) For purposes of a conventionally operated vehicle, every person who drives or is in actual physical control of a vehicle. See Tennessee Code 55-8-101
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • License: means any license, temporary instruction permit, or temporary license issued under the laws of this state, or any other state, pertaining to the licensing of persons to operate motor vehicles within this state. See Tennessee Code 55-12-102
  • Person: means a natural person, firm, copartnership, association, corporation, or an engaged ADS. See Tennessee Code 55-8-101
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in a perceivable form. See Tennessee Code 1-3-105
(b)

(1) The person may obtain reinstatement of the person’s driver license by meeting the following requirements:

(A) Submitting evidence of financial responsibility as required by this section; and
(B) Paying the fee provided for in § 55-12-129.
(2) After satisfying the requirements of subdivision (b)(1), the person is entitled to the return of operating privileges, otherwise suspended or revoked under this title.
