Terms Used In Tennessee Code 55-4-323

  • Owner: means a person who holds the legal title of a vehicle, or in the event a vehicle is the subject of an agreement for the conditional sale or lease thereof, with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, or in the event a mortgagor of a vehicle is entitled to possession, then the conditional vendee or lessee or mortgagor shall be deemed the owner for the purpose of this chapter and chapter 10, parts 1-5 of this title.   • State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
  • Vehicle: means every device in, upon or by which any person or property is or may be transported or drawn upon a highway, excepting devices used exclusively upon stationary rails or tracks. See Tennessee Code 55-8-101
(1) An owner or lessee of a motor vehicle who is a resident of Tennessee, upon complying with state motor vehicle laws relating to registration and licensing of motor vehicles and paying the regular fee applicable to the motor vehicle and the fee provided for in § 55-4-204, shall be issued a Masons new specialty earmarked license plate for a motor vehicle authorized by § 55-4-210(c).
(2) The application for a Masons new specialty earmarked plate must be accompanied by proof, satisfactory to the commissioner, certifying that the applicant is a member, or the spouse of a member, of the Free and Accepted Masons.
(3) The new specialty earmarked plates provided for in this subsection (a) must contain the logo of the Free and Accepted Masons. The plates must be designed in consultation with the Grand Lodge of the Free and Accepted Masons of the state of Tennessee.
(4)

(A) Subject to the requirements of § 55-4-202, the commissioner is authorized and shall issue a registration plate to an owner or lessee of a motorcycle who is otherwise eligible for a Masons new specialty earmarked license plate; provided, however, that the owner or lessee shall comply with the state motor vehicle laws relating to registration and licensing of motorcycles and shall pay the regular fee applicable to motorcycles and the applicable fee specified in § 55-4-204 prior to the issuance of the plate.
(B) The motorcycle plates authorized by this subsection (a) must be substantially the same in design and configuration, allowing for variations due to size restrictions, as the regular Masons new specialty earmarked license plate authorized by subdivision (a)(1).
(5) Funds produced from the sale of the Masons new specialty earmarked license plates must be allocated to the Masonic Widows’ and Orphans’ Home of Tennessee fund in accordance with § 55-4-301.
(6) Upon the death of the spouse who was entitled to receive the Masons new specialty earmarked license plate, the widow is entitled to receive a Masons new specialty earmarked license plate for a motor vehicle owned or leased by such widow, upon complying with state motor vehicle laws relating to registration and licensing of motor vehicles and paying the regular fee applicable to the motor vehicle and the fee provided for in § 55-4-204. The application must be accompanied by a copy of the death certificate.

(c)

(1) An owner or lessee of a motor vehicle who is a resident of this state and who is certified as a member or alumna member of Kappa Delta Sorority, upon complying with state motor vehicle laws relating to registration and licensing of motor vehicles and paying the regular fee applicable to the motor vehicle and the fee provided for in § 55-4-204, must be issued a Kappa Delta Sorority new specialty earmarked license plate for a motor vehicle authorized by § 55-4-210(c). The application for this plate must be accompanied by proof satisfactory to the commissioner, certifying the applicant to be a member or alumna member of Kappa Delta Sorority, and include the member’s initiating chapter name, initiating university name, and member number.
(2) The new specialty earmarked license plates provided for in this subsection (c) must be designed in consultation with the executive director and director of communications of Kappa Delta Sorority and contain the colors, logos, and other emblem or design distinctive to Kappa Delta Sorority.
(3) The funds produced from the sale of Kappa Delta Sorority new specialty earmarked license plates must be allocated to Kappa Delta Sorority National Headquarters in accordance with § 55-4-301. The funds must be used exclusively in this state to support the organization’s mission and operations, including professional and personal development programs, educational programming for collegiate chapters, the biennial national convention, recruitment and chapter extension efforts, marketing to potential new members, communications with current members, training of volunteers, technology advancements, operating fees, and the care and preservation of Kappa Delta Sorority archives.
