- Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
10. a. A violation of the provisions of this act shall be considered a violation of the “Solid Waste Management Act,” P.L.1970, c.39 (C. 13:1E-1 et seq.), and the commissioner shall have recourse to any of the actions or penalties provided for in section 9 of P.L.1970, c.39 (C. 13:1E-9), in order to address the violation.
b. The department shall have the right to enter, at any time during normal business hours and upon presentation of appropriate credentials, the premises of a recycling center, vehicle recycler, or producer of propulsion batteries in order to determine compliance with the provisions of this act.
